The following is the trial report at Tokyo District Court, between CJeS Entertainment and avex Management (Civil affairs 29th section, Heisei 23rd year (T/N: 2011)ワNo 17612. Complainant: CJes Entertainment, Defendant: avex Management. Heisei 23rd year, Oct 19, documents prepared by CJeS Entertainment)
“The deputy of the complainant” hereinafter means the lawyer of C-JeS, who is responsible for this trial in the Tokyo District Court.
‘Heisei 23rd year, Sept 22, the JYJ’s Korean deputy lawyer Sin Ji-Hye has made an inquiry to the deputy of the complainant as, “SM Entertainment has requested to reach a settlement including the trial going on in Japan, but it is difficult to understand the true reason why SM made such a proposal.”
Recently in Korea, for the lawsuit concerning the effect of exclusive contract between the management company and the artist, the Supreme Court has made a judicial decision that the long term exclusive contract is invalid. For the lawsuit (appeal trial) between SM and JYJ, there is high possibility that the court will rule in favor of JYJ, therefore, SM seems to be thinking to solve the trial (for both Korea and Japan) at the same time by legal settlement. Since SM has made a representation to the deputy lawyer Sin Ji-Hye, it means that the defendant will follow SM’s instructions. It can easily be guessed that the reason why the defendant is interfering with the complainant’s Japanese management (for JYJ) is because the defendant is considering SM’s intentions.”’
In the above, it is clearly written that SM has suggested of the settlement for SM and JYJ’s trial in Korea. Additionally, it is referring to the trial between avex and CJeS. Of course this is just a suggestion of judicial settlement, nothing more or less.
Since there are some documents prepared, I was waiting for some announcement from SM Entertainment, avex, and CJeS, but there are none such announcements up to today.
There should be various conjectures and guesses, but let’s calmly watch over the matter. When I reach confirmation, I am planning to write an article for various media.

Erm, actually, Cassiopeia has 53 stars. The constellation has 5 main stars and those are the ones that creates the distinctive W/M shape depending when and where you see it.
Besides, what about BigEast? BigEast aint got no stars, by that logic, Tohoshinki must have no members because BigEast should represent the only condition acceptable in Japan.
If the number of members is what makes TVXQ ‘official’ for you, then I guess SM can always add 3 new members to TVXQ.
What? You said five members, you never said it has to be the three who have left to create their own group.
Let’s face it OT5, the problem isn’t the number of members TVXQ has, the problem is that your oppa is no longer in it. That or this separation has caused your OTP to go their separate ways and you’re just a tad bit to insecure to admit your OTP might not be the ULTIMATE OTP like you claim it was.

Forever crying. Yunho, Changmin. You’ve gone through a lot. Yet so many JYJ stans refuse to hear your story. Keep fighting on! Some people need to open their eyes. Please read from this site for some articles that have become unavailable to international fans due to some biased fans. Because of this, their story has gone and only claims of JYJ’s suffering have been heard.
Please take your time to read through the posts, to understand what was the true intention of the lawsuit. Then understand why some people still support homin. Don’t give them anymore shit. Just don’t. Because you’re disgusting. I can’t stand it anymore.
Though I support JYJ, I don’t fully support what they have done. Stop blaming homin. What have they gone through? Yunho, does he still smile the same way? Changmin, how much growing up must he have gone through? Yet they keep smiling because they still can perform for their fans.
Telling TV2XQ to change the name of their fanbase. Does this make you right in any way? Can you still call yourself a Cassie for only supporting JYJ?

I’m sorry, I’m rambling mindless crap and haters are gonna hate.I just want them to understand the other side. Don’t call yourself ot5 if you only follow three of them. Pick up their album, listen to their music. It’s beautiful. beautiful.
I’m just super emotional right now. Somewhat depressed, and reading about how these two strive through to their comeback always makes me somewhat lighter.
So why am I ranting about JYJ some certain JYJ stans and fansites?
Because I know I was one of those JYJ stans, who after the breakup, only followed JYJ. I know how you guys feel. But what I heard were only rumours, I refused to listen to what homin had to say. I blocked out their music. Up until last night. I watched the Before U Go mv.
And.
My.
Emotions.
It was too beautiful. My Changmin baby. Yunho. I could see emotions, so much in the video. all 16 minutes and one second of it. My eyes were glued to the screen.
Oh god, I cried. And opened up my eyes. and remembered who they were and how much I missed them. So I started reading up, replaying their KYHD and Tone albums. I did some research and found out so much about what actually happened. I was blind to all this because all this time, I had only been following biased bullshit filled JYJ fansites.(they tend to leave out very important details)
So it was like a change of heart I guess..?
I can relate to all of you guys who are just about to bash me for what I have just ranted about. take your time, read through the links and decide for yourself if the rumours and biased information is what you should only believe in.

The situation: While DBSK was filming a variety show on October 14, 2006, U-Know was rushed to the hospital after drinking a beverage which was laced with super glue that had been given to him by an anti-fan. His manager quickly instructed him to vomit right afterward. The anti-fan turned herself in the next day. The female suspect, whose surname is Ko, was apprehended on October 16, was a member of an anti-TVXQ website for over two years.
Ko wrote a letter to U-Know:
“To Jung Yunho,
You watch your mouth!! Ever since the debut you were so stuck up. You
won't last after a couple years... You would be forever seen as some teen
idol not real singer. Do you know your limit? Only little kids like you!...
I really want to kill you.”
There were many unanswered questions, such as why U-know drank from the open container, and how the culprit managed to enter the building of the broadcasting station. U-Know called the police and requested that they not charge Ko because he has a little sister who was near her age.

Temporary Contract Injunction

Filed by CJS against SM.
Judgment was given on Oct 27 of the same year. The judge granted CJS temporary suspension of the contract until the actual lawsuit so they can continue on with their activities without SM’s interference.
There was no judgment regarding the contract from this trial. Many think CJS won the case because of this injunction, but that is not true. The judge only ordered temporary suspension of the contract, but didn’t rule on the contract itself. That is to be determined from the actual lawsuits listed below.

Now, the lawsuits have not been settled, they are currently still on-going.
If CJS wins, they will have voided their contracts and be under no obligation to pay SME the contract termination fees. They can then also officially make C-Jes their management; as of now C-Jes is a third-party to their contracts with SME and is an agent they are using for their activities, NOT their official management agency. CJS are technically still under SME even if it’s in nothing but name.
If SME wins, CJS will have to incur all the penalties involved with every breach they’ve made of the terms in their contracts. Also whatever contracts they’ve signed with C-Jes will probably be nullified (illegal). Since they have said in the past that it’s all about JYJ and due to the acrimonious relationship they have with SME, I doubt they will want to remain a part of it, and will fork out the termination fees to be free of their contracts. They can then sign under C-Jes again, this time officially.
Both are going to have the same end-result. The only difference is how much monetary loss the side who loses will sustain.
Onto something else:
‘We believe we need to start preparing for the Korean activities planned for next spring at least 6 months in advance before our big future becomes uncertain. We hope the 3 members can make a decision before it’s too late if they truly want to continue as TVXQ.’

The vocals track with five voices is actually proof that there may have been plans for a comeback in 2010 with all five members, as per the letter written above.
IMO, MAXIMUM was a demo track that either never made the cut in their previous albums, or was recorded with the intention that it be included in a subsequent album with five of them. The recording was made before the temporary contract injunction, that much is clear. CJS had already broken contact with SME by that point.
If you look at the MAXIMUM video, Yunho and Changmin are dancing to the choreography intended for two, meaning they intended to perform it as two by the time the practice video was taken and the other three were not coming back. Most likely, they had not yet recorded MAXIMUM with their two voices yet.
If anything, this should be making fans of the old TVXQ more depressed than anything else, with the ‘what could’ve been’s.

You know what, SME and JYJ should settle the lawsuits already. Give the fans their closure. At this point it’s just painful observing the suffering of OT5s as their emotions are blown every which way by any scrap of old info revealed. It’s not even funny anymore, I really feel like I’m watching martyrs sacrificing themselves for something that isn’t true and may never come to pass.
